A BILL to amend article three, chapter twenty-three of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
four, relating to workers' compensation; and phasing out the
health care coverage over a two-year period.
Be it enacted by the Legislature of West Virginia:
That article three, chapter twenty-three of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section four,
to read as follows:
ARTICLE 3. WORKERS' COMPENSATION FUND.
§23-3-4. Two-year phase out of health care.
Notwithstanding any other provision of law to the contrary, the commissioner shall develop a procedure and rules to phase out
the health care coverage and provisions of this chapter so that
health care is returned to and becomes the responsibility of
health care plans of employers and employees, wherever possible
and economically feasible.
NOTE: The purpose of this bill is to remove health care
from Workers' Compensation benefits over a period of 2 years and
to return the responsibility for these benefits to the health
care plans of the employers and employees.
